New Regulations for Readily Available House Transactions Take Effect - Greater Transparency with Mandatory Disclosure of Building Energy-Efficiency Rating Labels and Solar Equipment

The Ministry of the Interior has announced amendments to the “Mandatory Provisions for Standard Contracts in Readily Available House Transactions (成屋買賣定型化契約應記載事項)” and the “Mandatory Provisions of Real Estate Manual (不動產說明書應記載事項)” as part of its push toward the nearly zero-carbon buildings policy and enhanced transparency in real estate transactions. The new regulations officially take effect today (1st). Under the new rules, real estate broker must disclose whether a property is equipped with solar photovoltaic systems, as well as provide information on the building energy-efficiency rating label when conducting transactions involving readily available houses. The Ministry stated that it will integrate this information into the real estate transaction database website (不動產交易實價查詢服務網), allowing the public to not only be able to check actual transaction prices but also to assess the building’s energy performance. This initiative is expected to improve transparency while making the value of green and sustainable buildings more visible in the market.

Regarding the standard contract for readily available house transactions (成屋買賣定型化契約), revisions to the annexed “Confirmation of the current status of the Premises (建物現況確認書)” introduce new disclosure requirements, including: 1. Whether the building is equipped with a solar photovoltaic power generation equipment , along with details on installation basis, location, and maintenance status; 2. In alignment with updates to the “Design Specifications for Concrete Structures  (建築物混凝土結構設計規範),” the inclusion of testing method and standard for chloride ion limitation in hard concrete (硬固混凝土中最大水溶性氯離子含量); 3. Whether the property’s community includes a “booster pump water supply system,” along with clarification of management and maintenance responsibilities, in order to prevent future disputes.

In addition, the instruction of real estate, prepared by broking agents upon being engaged by property owners to sell a property, must now include disclosures on whether the building has obtained an building energy-efficiency rating label and whether it is equipped with solar photovoltaic systems. These details, along with any existing information on property rights, surrounding environment, current condition, defects, and transaction terms, must be fully explained to buyers during the transaction process.

The Ministry emphasized that real estate transactions involve significant financial value, and adequate disclosure of information is critical to protecting consumer rights. Following the implementation of the new system, businesses are required to use the updated standard contract for readily available house transactions (成屋買賣定型化契約), and broking agents must prepare and present the revised instruction of real estate in accordance with regulations.

The Ministry further noted that if members of the public find that operators have failed to comply with the regulations, they may report or file complaints with the local city or county government where the property is located.
